Biography

Hon. Mark H. Pierce (Ret.) brings a wealth of experience spanning nearly five decades in a wide range of complex civil matters to the panel of neutrals at Signature Resolution.

In his role as a mediator and arbitrator, Judge Pierce is poised to bring an elite level of civility and fairness to all mediation cases at Signature Resolution. He firmly believes that faith and understanding from the participants in any legal matter are earned through comprehensive and empathetic listening skills. Citing mediation as one of the most satisfying aspects of his practice, Judge Pierce believes that mediation often produces the best results for all parties searching for resolution.

The key to Judge Pierce’s approach at Signature Resolution is the ability to synthesize every detail of a case and understand and relay the motivations of either party in order to reach an agreement that allows for the satisfaction and ability to move forward amicably.

Judge Pierce’s early legal tenure included positions at several respected firms, including Clark & Glennon and Kelly, Legal, and Olimpia, which he credited for mentoring him and providing invaluable experience. In 1985, he became a partner at Olson & Pierce, where he specialized in personal injury and workers’ compensation. After completing the mediation program at Harvard University in 1994, Judge Pierce dedicated his work to aiding clients in the business, employment, liability, medical malpractice, personal injury and real estate spheres. His notable legal victories include helping a Vietnamese diaspora victim reclaim his life’s savings—a case that not only restored his client’s assets but also solidified Judge Pierce’s reputation, earning him continuous referrals from impressed peers.

Throughout his career, Judge Pierce has been active in his community including serving as a member of the Saratoga Planning Commission, the Santa Clara County Bar Association, the Consumer Attorneys of California, and as President of the Santa Clara County Trial Lawyers Association.

Judge Pierce began his legal career in 1975 and was driven by a profound interest in history and political science which guided him to pursue legal studies. This passion, instilled by his parents, guided him toward a career that spans across various facets of civil law.

Influenced by family friends who served on the bench, Judge Pierce was inspired to pursue a career as a judge during his time in private practice. In 2005, his legal expertise and esteemed reputation led to a swift appointment by former Governor Arnold Schwarzenegger to the Santa Clara County Superior Court. Typically a lengthy process, his appointment was completed in just six months, further demonstrating his exceptional credentials within the legal community. Over the next 15 years, Judge Pierce served on the Superior Court of California, where he developed a legal philosophy centered on patience and thorough listening, essential for effective mediation and negotiation.
